Terms of Service
Effective 4 November 2026
These terms are an agreement between you and Tarakan Limited ("Tarakan", "we", "us"), a company based in New Zealand. They apply when you download or play Mess About or any other mobile game we publish (the "Games"). By downloading or playing a Game you agree to them. If you do not agree, do not download or play the Games.
If you are under 18, or under the age of majority where you live, please ask a parent or guardian to read these terms with you. A parent or guardian who lets a child play agrees to these terms on the child's behalf and is responsible for the child's use of the Games.
The short version
- Our Games are free. There is nothing to buy and no subscription.
- Ads pay for the Games, and we set them up to be non-personalised and age-appropriate.
- There is no account. Your progress is saved on your device, and deleting a Game deletes it.
- Play fair: do not cheat, hack, or fake ad views.
- The Games are provided as they are, and our responsibility for them is limited as far as the law allows.
Who we are
Tarakan Limited is a company registered in New Zealand. We make the Games as a business, which means we act as a trader under the consumer protection laws of the European Economic Area and the United Kingdom. You can reach us at hello@tarakan.app.
Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to download the Games and play them on devices you own or control, for your own non-commercial entertainment. The licence lasts until you or we end it under these terms.
The Games, including their code, art, music, sound, levels, characters, and names, belong to Tarakan or the people we license them from. Apart from the licence above, these terms do not give you any rights in them, and we keep all rights we do not expressly give you.
Free to play, paid for by ads
The Games cost nothing to download or play and have no in-app purchases, subscriptions, or loot boxes. If we ever add something you can buy, we will tell you its price clearly before you pay, and update these terms first.
Ads are served by Google AdMob, and we set them up to be non-personalised and limited to age-appropriate (G-rated) content. Google and advertisers choose which ads are shown, not us, so we are not responsible for the content of ads or for the websites, apps, products, or services they lead to. Some Games offer a reward, such as recharging the battery in Mess About, for watching an ad. Watching one is always your choice. If you see an ad that seems inappropriate, please tell us.
Stars and other in-game items
Stars, furniture, keepsakes, streaks, and anything else you earn in a Game exist only inside it. They have no money value, cannot be bought, sold, or exchanged for money or anything else, and are not your property. They are part of the licence to play.
We may change how items are earned, what they do, or what they unlock at any time. We try not to take away progress you have earned, but we may remove items or progress gained through cheating, exploits, or bugs.
Your progress
The Games have no accounts. Your progress and settings are saved on your device only, so they do not move to a new device, and uninstalling a Game, resetting your device, or clearing its storage deletes them permanently. We cannot restore lost progress because we never hold a copy.
Playing fair
When you play, do not:
- Cheat, or use bots, modified versions of a Game, or tools that change how it works.
- Copy, modify, decompile, or reverse engineer a Game, except where the law lets you do so regardless of these terms.
- Click on, view, or interact with ads in a way that is fake or automated, or try to earn rewards without genuinely watching.
- Interfere with the servers or services the Games rely on, or try to get around their security.
- Sell, rent, or redistribute a Game or its content, or use them for commercial purposes.
- Use a Game in a way that breaks the law.
Playing safely
A very small number of people may have seizures or other symptoms when they see certain flashing lights or patterns, including in video games, even if they have never had one before. If you or your child have had seizures or epilepsy, talk to a doctor before playing. Stop playing straight away and see a doctor if you feel dizzy or unwell, or have changes in vision, twitching, or any involuntary movement.
Take regular breaks, and do not play while driving, walking, or doing anything else that needs your attention.
Updates and changes
We keep improving the Games, so we release updates that fix bugs, add rooms or features, or change how things work. Some updates may be needed to keep playing, and some features, like the Daily Challenge and ads, need an internet connection.
We may change, suspend, or remove any feature, or stop offering a Game, at any time. Where we can, we will give reasonable notice first. We do not promise that a Game will work on every device or operating system version, or that any feature will stay available.
Ideas and feedback
We love hearing from players. If you send us ideas, suggestions, or feedback, you agree that we may use them to improve our Games or make new ones, without paying you, crediting you, or keeping them confidential. Please do not send us anything you want to keep the rights to.
Privacy
Our Privacy Policy explains what information the Games use and how we handle it. It is a separate notice, not part of these terms.
App stores
You download the Games from the Apple App Store or Google Play, and their terms also apply to your download. These terms are between you and Tarakan only, not Apple or Google, and Tarakan, not Apple or Google, is responsible for the Games and for any support, maintenance, or claims relating to them.
If you downloaded a Game from the Apple App Store, Apple's standard licence agreement for apps (the Licensed Application End User License Agreement) also applies, and these terms add to it.
Your consumer rights
Some laws, such as consumer protection laws in New Zealand, Australia, the European Union, and the United Kingdom, give you rights that cannot be excluded or limited by agreement. Nothing in these terms excludes or limits those rights. Where these terms say "as far as the law allows", they apply only as far as those laws permit.
Our responsibility to you
The Games are free and run on many different devices, so we cannot promise they will always be available, uninterrupted, secure, or free of bugs. As far as the law allows, the Games are provided "as is" and "as available", and we give no promises, conditions, or warranties about them, whether express or implied, including about their quality or their fitness for any particular purpose.
As far as the law allows, we are not liable for: indirect, consequential, or unforeseeable loss; loss of profit, revenue, business, or opportunity; loss of data or progress; loss caused by ads or by other people's products and services, such as app stores, device makers, and internet providers; or failures or delays caused by events beyond our reasonable control.
As far as the law allows, our total liability to you for all claims relating to the Games or these terms is limited to NZ$100. The Games are free, and this limit reflects that.
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
Ending these terms
You can stop playing at any time by uninstalling a Game. We may suspend or end your licence if you break these terms, for example by cheating or committing ad fraud, and it ends for everyone if we stop offering a Game. Sections about ownership, ideas and feedback, consumer rights, our responsibility, governing law, and general terms continue to apply after the licence ends.
Changes to these terms
We may update these terms, for example when we change a Game or the law changes. We will post the new version here with a new effective date. If a change materially affects you, we will say so on this page before it applies. If you keep playing after a change applies, you accept the new terms. If you do not agree with a change, stop playing and uninstall the Game.
Governing law and disputes
These terms are governed by the law of New Zealand, and the courts of New Zealand can hear disputes about them. If you are a consumer living elsewhere, including in the European Economic Area or the United Kingdom, you can also bring a claim in the courts where you live, and the mandatory consumer laws of that country still apply.
If you have a problem, please email us first: most things can be fixed quickly.
General
We may transfer our rights and obligations under these terms to another company, for example if our business or a Game is sold. You may not transfer your rights under these terms to anyone else.
These terms are the whole agreement between you and us about the Games. If we do not enforce a term straight away, we can still enforce it later. If any part of these terms is found to be unenforceable, the rest still applies.
